The environment ministry has notified the stringent ‘Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2017’ under the Prevention of Cruelty to Animals Act. According to the notification, the member secretary of an animal market committee will have to ensure that no person brings a young animal to the animal market a brief summary of act :

Prevention of Cruelty to Animals (Regulation of Livestock Markets) Rules, 2017 derived from Primary Act: Prevention of Cruelty to Animals Act, 1960.

As all act/rule this The Rule applies to the whole of India, except the State of Jammu and Kashmir.

Under this rule Cattle cannot be brought to an animal market for sale for slaughter.

What are the animals under this Rules :
A bovine animal including bulls, bullocks, cows, buffalos, steers, heifers and calves and includes camels.

What is a Marketplace called :
Market places are where animals are brought from other places for sale or auction. It includes animal fairs, or areas adjoining a market or a slaughterhouse.

How to know it is genuine market place :
All existing animal markets will have to be registered within three months with the District Animal Market Monitoring Committee by making an application to the Committee.

Under this rules what centre government prescribe :
(i) Cruel and harmful practices have been prohibited for animals including, painting of horns, ear cutting buffaloes, making animals lay on hard ground without proper bedding.

(ii) Purchaser of cattle cannot sell animal for slaughter or sacrifice the animal for religious purposes.

(iii) The rule mandates the appointment of Veterinary inspectors who shall screen the animals before they enter the market. The inspector shall also check whether animals are being transported in trucks which are authorised by law to carry animals.

Already kerala Chief minister vehemently opposed this rules and social media tore apart under the #beefban.

Senior law practitioners wondered how this single rule notified by centre that is not amended by parliament can control existing market place that comes under state cause list a right that is been entitled to state Governments.
