Upper caste 10% quota for weaker section by BJP

The Union Cabinet on Monday approved a 10 per cent reservation for economically weaker sections of the society. The quota is for jobs for those belonging to the weaker sections among the upper caste. The reservation can also be availed for admission in higher educational institutions.
 
Though governments in states like Haryana, Rajasthan and Maharashtra have made laws, they are often struck down by the court on the ground of a Supreme Court judgement in the Indra Sawhney case had fixed a ceiling of 50 per cent on reservation.
“For the first time, BJP (govt) are now going to give constitutional recognition to the poor from the upper castes,”
 
Who all are eligible for the quota :
Upper caste People who earn less than Rs 8 lakh annually
Upper caste  People who have agricultural land below five acres
Upper caste  who have  a residential house should be below 1000 sq ft
Upper caste  residential plot should be below 100 yards in notified municipality
Upper caste  residential plot below 200 yards should be in a non-notified municipality area
 
The government is likely to bring constitutional amendment bill on quota in Parliament on Tuesday.
 
The apex court has also asserted that the Constitution makes no case for quota on economic ground and only talks of educational and social backwardness besides those for the SCs and STs.
 
Legal experts told this bill bound to invoke legal litigation in the days to come if passed in both the Houses
